Failure to act during birth can lead to trauma for the baby

Failure to act during birth can lead to trauma for the baby

The birth of a baby should be joyous occasion for the parents, but this isn’t always how things happen. There are many factors that can change and make the labor and delivery a somber one. It’s imperative that everyone who is involved in the experience pays close attention to what’s going on with the mother and the baby.

One of the most important things that happens during the labor process is the monitoring of the mother and baby. This is typically handled by the nurses who are trained to spot signs that something is amiss. When there is any indication that the baby or mother isn’t doing well, swift action is necessary.

Types of injuries

Many types of injuries can occur during labor and delivery malpractice. During labor, the baby’s heartbeat in response to contractions must be monitored. If the heartrate dips and can’t recover, the baby may be in danger and an emergency surgical delivery is likely warranted. The nurses and other labor attendants should remain vigilant about the information presented on the monitors. Failing to act quickly when something is amiss can lead to the wrongful death of the baby and possibly the mother.

The delivery is another time when things can go wrong. Shoulder dystocia, uterine rupture, and similar issues can lead to problems during the delivery. In some cases, the practitioner may have to use forceps or a vacuum to help guide the baby out of the birth canal. Procedures like this can cause serious issues if they aren’t handled correctly, but not doing anything can also be problematic.

Many types of injuries can occur during the course of childbirth. These include head trauma, which can involve skull fractures and hematomas. Brachial plexus injuries, spinal cord injuries, and facial injuries are also possible. These may cause only temporary issues, but they are sometimes lifelong and require considerable treatment.

When injuries occur

When a birth injury does occur, the parents need to ensure that they’re doing what they can to help their baby. Seeking compensation via a medical malpractice claim is possible, and they must do this before the state’s statute of limitation runs out. Opting to seek compensation isn’t an easy path, but it is one that can help them to afford the care and treatments the baby will need throughout life. Because they can only receive compensation once, they should include the projected cost of future care into the claim.
