Soldier files medical malpractice claim after missed diagnosis

Cancer is a disease that no person wants to face. However, the majority of families in Kentucky have been affected by cancer one way or another. A man in another state filed a medical malpractice claim after doctors allegedly failed to diagnosis his cancer.

The man was a soldier with the Green Berets and said his doctors missed his lung cancer. According to his lawsuit, the man began having breathing difficulties not long after undergoing a routine physical. The man says he eventually visited an ER at a military medical center only to be examined then sent home. Allegedly, the plaintiff's condition continued to worsen to the point where he began coughing up blood.

The plaintiff says he begged to be seen by a specialist, only to be put off for an entire month by the military and his insurance. After finally being seen by a pulmonologist, the lawsuit says a mass was found on the plaintiff's lung. A biopsy revealed that the man had terminal lung cancer, according to the suit. The plaintiff accuses his military doctors of negligence and says a missed diagnosis led to his cancer growing to the point of being terminal.

Although United States citizens have access to skilled physicians and state-of-the-art healthcare technology, mistakes will continue to happen. When a mistake leads to the injury or death of a patient, victims and immediate family members in Kentucky can take legal action through a medical malpractice claim.
