After having a child and finding that the child was injured in some way during the process, you need to look into all of the information relating to what happened, what rights you have and all of your options. A good place to start is by taking a look at some of the more common birth injuries that are reported so that you can see if your situation matches up.

At the very top of the list is cerebral palsy. A different condition that is sometimes referred to is known as Erb’s palsy; though the two are different, both can stem from errors during birth.

Sometimes, the tools used to help the child be born are actually to blame for the injuries. Did the doctor decide that he needed to use forceps at some point in the process? Did he decide to use a vacuum extraction device? If so, there could be many injuries stemming from these if they were used incorrectly or when they were not needed.

In some cases, a C-section — or a cesarean section — is used to help a child be born when there are complications preventing a natural birth. Not only could mistakes during this process lead to injuries, but the failure to do a C-section when it is needed could also harm the child.
